TERMS AND CONDITIONS
Effective date: October 17, 2026
These Terms and Conditions govern your use of abdullahmasud.com and the AM Client Portal, and the services I provide as Abdullah Al Masud, a freelance web developer and designer. By using my websites or confirming a project with me, you agree to these terms. A written proposal or project agreement may add to or replace parts of these terms for a specific project. Please also read my Privacy Policy.
1. WEBSITE PURPOSE
My website presents my professional web design and development services. Its content is general information. It does not by itself create a client relationship, guarantee availability, or make a binding offer.
2. ENQUIRIES AND PROPOSALS
Sending a contact form or email is a request to discuss work, not an automatic acceptance of a project. The scope, deliverables, timeline, and budget are agreed in writing before a project is confirmed. Quotes may expire on the date shown in the proposal.
3. CONFIRMING AND STARTING A PROJECT
Once we agree to work together, I first invite you to the AM Client Portal. Then I send the invoice for the first 50% of the project budget through the portal. A project is confirmed and started only after that payment is received. I do not begin any work before this payment.
4. FEES AND PAYMENT
Step 1: I invite you to the AM Client Portal.
Step 2: I send you an invoice for 50% of the project budget through the portal. You pay it to confirm and start the project.
Step 3: After I deliver the project, I send the invoice for the remaining 50%, and you pay it.
Invoices are paid by bank transfer.
Invoices stay in your portal permanently, so you can download them whenever you need.
Any third-party costs (such as hosting, domains, premium plugins, or themes) are agreed with you before they are charged.
5. TIMELINE AND DELAYS
6. CLIENT RESPONSIBILITIES
You agree to:
- Give accurate information, content, brand assets, access, and approvals in reasonable time.
- Make sure you have the rights to all materials you give me, and that your business and requested features follow the law.
- Keep your portal login details private.
Delays in your inputs may change the delivery date.
7. CHANGES AND ADDITIONAL WORK
Requests beyond the agreed scope may need a new timeline and extra fees. I will confirm these with you before starting the extra work. Each project includes unlimited rounds of revisions until satisfaction.
8. AM CLIENT PORTAL
Portal accounts are created by invitation only, using the email address I send the invitation to. That email address cannot be changed. You choose your own password, and I cannot see it. Project updates, files, messages, and invoices are shared through the portal. Project messages and files are kept, but general messages and files that are not part of a project are deleted automatically after 120 days, so please save anything important before then. You may use the portal only for your own project and for communication with me. The AM Client Portal also has its own terms, and my Privacy Policy explains how your information is kept.
9. REFUND POLICY
I want you to feel safe working with me. If something goes wrong on my side, you can get your money back. Refunds are handled personally and fairly.
9.1 Valid reasons for a refund request
A refund request is valid when one of the following has actually happened:
a) I did not deliver the project on time and did not tell you why. (Delays caused by your review time, custom design, or custom code are not counted, as explained in section 5.)
b) Major features we agreed on are missing from the delivered project.
c) There is a serious fault that I could not fix.
d) I did not send you proper project updates or invoices in the portal.
9.2 Automatic full refund
If I cannot continue your project for a reason on my side, for example I do not have enough time to complete it, or a serious circumstance such as illness stops me, I will refund you in full for everything you have paid. You do not need to ask. No deduction is made in this case.
9.3 How to request a refund
For the reasons in 9.1, contact me directly at [your email]. Explain what happened and which reason applies, with details and proof such as dates, messages, or portal records. I will review your request and tell you my decision clearly. Only reasons that have genuinely happened are approved.
9.4 When you can request a refund
- Before delivery: at any time while the project is in progress.
- After delivery: within 14 days of the delivery date. After 14 days, refund requests are no longer accepted.
9.5 When you receive the refund
Once I approve a refund, I will pay it within 7 to 14 days, to the same bank account the payment came from where possible.
9.6 Deductions
I only deduct for work that was actually delivered and usable by you. I will explain the exact amount before I process the refund. I never deduct when the reason is on my side, as in section 9.2.
9.7 Keep your records
Please keep your own copy of anything important you send outside a project, because general portal messages and files are deleted automatically after 120 days. Project messages and files are kept, but download anything you need for your own records.
10. OWNERSHIP AND INTELLECTUAL PROPERTY
After full payment, you own the final website content and design I created specifically for your project. I keep ownership of my pre-existing tools, methods, templates, and reusable code. Third-party themes, plugins, fonts, images, and software remain under their own licences. I will show your project in my portfolio only if you agree.
11. THIRD-PARTY PLATFORMS AND SERVICES
Projects may rely on third-party hosting, WordPress, Elementor, themes, plugins, APIs, and other services. Their availability, pricing, policies, and data practices are outside my control and may change. You are responsible for third-party accounts and fees assigned to you unless we agree otherwise.
12. USE OF AI TOOLS
I may use AI tools to help with parts of my design and development workflow. I review the work I deliver. If your project includes AI-powered features, such as chatbots or automation, results can be incomplete or inaccurate, and you should review important outputs before using them publicly or in your operations.
13. NO GUARANTEED RESULTS
I aim to deliver professional, high-quality work, but business results depend on many things outside my control. Traffic, search rankings, leads, sales, conversions, and uninterrupted hosting are not guaranteed unless a written agreement clearly says so.
14. ACCEPTABLE USE
You may not misuse my websites or the portal, attempt to access accounts or data that are not yours, disrupt their operation, upload harmful or unlawful content, or use them for fraud.
15. WEBSITE CONTENT
Unless stated otherwise, the text, branding, graphics, and design of my websites are owned by me. You may view and share links to them. You may not copy, republish, or sell substantial parts of them without permission.
16. DISCLAIMER
My website and free content are provided “as available”. To the extent allowed by law, implied warranties are excluded. Nothing on my websites is legal, tax, financial, or other regulated professional advice.
17. LIMITATION OF LIABILITY
To the extent allowed by law, I am not liable for indirect, incidental, or consequential loss, lost profits, lost data, lost opportunities, or failures of third-party platforms. For a paid project, my total liability is limited to the amount you actually paid for that project. This does not limit liability that cannot lawfully be limited.
18. SUSPENSION AND ENDING OF SERVICES
Access or services may be paused or ended for serious breach of these terms, abuse, security risk, unlawful requests, or conduct that makes the work unsafe or impractical. Refunds in that case follow section 9. Terms meant to continue after the work ends, such as payment, ownership, and liability, remain in effect.
19. GOVERNING LAW AND DISPUTES
Unless a written project agreement says otherwise, these terms are governed by the laws of Bangladesh. If there is a disagreement, we will first try to solve it in good faith through written discussion. Unresolved disputes go to the courts of competent jurisdiction in Bangladesh, subject to any consumer rights that apply where you live.
20. CHANGES TO THESE TERMS
I may update these terms as my services or legal requirements change. The effective date shows the latest version. Updates do not change a project that was already confirmed unless we both agree.
